Alarm Responds to MOJ Consultation
Alarm is pleased to
share our response to the further consultation exercise on
‘Extension of the RTA scheme to include employers’ and public
liability claims up to the value of £25,000’ on behalf of our
members.
Alarm's response is based on consultation with our membership
together with a data collection exercise, and has been endorsed by
a number of member authorities.
The Public Sector is increasingly hard pressed to find the
resources needed to deliver services which are valued by the
public. Alarm continues to believe that excessive legal costs are a
grave burden on public organisations and do not add value in terms
of supporting the injured party. These increasing and excessive
costs diminish the funds available to deliver front line services,
and this is our primary area of concern.
Following a recent data collection exercise, an example of the
effects on the public purse can be clearly demonstrated. Based on 3
year claims data drawn from highway PL claims settled between April
2009 and March 2012, supplied from a statistically relevant number
of large Metropolitan councils, each public liability highway claim
that settles below £5,000 costs the public purse on average £8,354
in claimant legal costs, whereas the average settlement received by
the claimant in these matters is just £2,687. This is a wildly
disproportionate costs / damages ratio of over 3:1 that is being
met directly from Local Government resources.
