Storm Arwen swept across the UK, causing untold damage to properties, highways and the environment in November 2021. The latest in a series of extreme weather events, the impacts on public service organisations are long-lasting. Such events lead to an influx of third-party claims including tree-related damages.  

Tim Smith, Partner at Forbes Solicitors reviews the legal duties and responsibilities of public sector organisations in dealing with these claims. He provides top tips for gathering evidence, claims investigation and the use of expert evidence. Tim also explores typical scenarios with defective trees already subject to decay, the defence of these claims in the absence of any formal inspection regime and further action moving forward.
