Webinar Wednesday – Highways flooding

Climate change has led to a nine per cent increase in significant rainfall in the past 50 years with increasingly more frequent periods of heavy rainfall in excess of 50mm. Inevitably, with greater urbanisation the increased levels of rainfall have caused more frequent and significant flooding of land and property in recent years. In the next 50 years, it is estimated that flooding events in the UK could increase by up to 35%.  

More frequent and significant rainfall impacts the highway infrastructure and results in a large proportion of those flooding events. Roger and Asena will discuss the duties councils owe under the Highways Act 1980 to maintain the highway surface and drainage systems and consider how the extent of those obligations have developed through case law and the different causes of action that may also arise in negligence and nuisance. As part of those discussions, we will address areas of concern for organisations and practical measures that can be taken to reduce any potential liabilities.
